Terms of Service

1. Introduction

These general terms of service (the "Terms") govern the use of PiTrio, operated by Tomáš Smékal, Company ID: 04695984, registered at Zvoncovitá 1974/1, Stodůlky, 155 00 Praha 5 (the "Provider"). By registering or using the service you agree to these Terms.

2. Description of the service

PiTrio is a web application for photographers enabling photo uploads, online galleries, sharing with clients, marking favourite photos, commenting, submitting photo selections and downloading them. The service is provided "as is".

3. User account

• Registration is required to use paid features.
• The user is responsible for the accuracy of their data and the security of their credentials.
• The user must be at least 18 years old or otherwise have capacity to enter into a contract.

4. Plans, prices and payments

• The service is offered in Free, Basic and Pro plans. Current prices and scope are listed in the Pricing section.
• All prices are stated as final, inclusive of VAT at the applicable statutory rate. The Provider is a VAT payer.
• Paid subscriptions are billed in advance per billing period (monthly) via a payment gateway.
• Subscriptions renew automatically until cancelled by the user.

5. Cancellation and withdrawal

A subscription can be cancelled anytime; it stays active until the end of the paid period and then does not renew.

Consumers have the right to withdraw from the contract within 14 days of its conclusion, without giving a reason. The service is made available immediately upon payment, i.e. before that period expires — and only at the consumer's express request, given by ticking the consent box before payment. If a consumer withdraws during the 14-day period, they pay a proportionate part of the price corresponding to the performance provided up to the moment of withdrawal (Section 1834 of the Czech Civil Code); the Provider refunds the remainder. The right of withdrawal expires only once the service has been provided in full (Section 1837(a) of the Czech Civil Code).

6. Content and user rights

• Uploaded photos and other content remain the property of the user or the respective copyright holder. The Provider acquires no rights to the content beyond the license under this article.
• The user warrants they hold all rights to the uploaded content and that its publication does not infringe third-party rights.
• The user must not upload unlawful, offensive or otherwise objectionable content.
• The user grants the Provider a limited license to store and display content solely to provide the service. The license ends when the content is deleted or the account is cancelled.
• The user is solely responsible for the content of uploaded photos. The Provider does not review uploaded content and bears no responsibility for it; upon discovering a breach of these Terms it may make the content unavailable.

Reporting illegal content (Art. 16 of Regulation (EU) 2022/2065 – DSA): If you believe that illegal content (e.g. copyright infringement, violation of personality or other rights) is made available through the service, report it to info@pitrio.cz. Include the link (URL) to the specific content, a description and the reason you consider it illegal, and your contact details. I will assess every proper notice without undue delay and disable or remove any illegal content, informing both the notifier and the affected user of the outcome.

7. Service availability

The Provider strives for maximum availability but does not guarantee uninterrupted operation. The service may be temporarily unavailable due to maintenance or circumstances beyond the Provider's control.

8. Limitation of liability

The Provider is not liable for the content of uploaded photos or for damages arising from the conduct of the user or third parties (e.g. copyright infringement by uploaded content, sharing a link with an unauthorised person). To the extent permitted by law, the Provider is not liable for indirect or consequential damages or data loss caused by circumstances beyond its control; any liability of the Provider is limited to the amount paid by the user for the service in the last 12 months. Consumer rights that cannot be contractually limited remain unaffected. The Provider recommends keeping backups of original photos outside the service.

9. Termination

The Provider may restrict or terminate an account for breach of these Terms. The user may cancel anytime.

10. Personal data

Processing of personal data is governed by the privacy policy. For personal data of the user's clients and gallery visitors that the user uploads to the service, the Provider acts as a processor — the data processing agreement under Art. 28 GDPR forms an integral part of these Terms.

11. Out-of-court dispute resolution

If a dispute between the Provider and a consumer cannot be resolved directly, the consumer has the right to seek out-of-court dispute resolution. The competent authority is the Czech Trade Inspection Authority (ČOI), Štěpánská 15, 120 00 Praha 2, www.coi.cz. Disputes may also be submitted through the Online Dispute Resolution (ODR) platform operated by the European Commission: ec.europa.eu/consumers/odr.

12. Governing law and final provisions

These Terms are governed by the laws of the Czech Republic. The Provider may amend the Terms and will inform users of material changes. Contact: info@pitrio.cz.
